Multinational managers and executives from the overseas affiliate, parent company, subsidiary or branch seeking to transfer to the US company may be eligible for this category. Same with the EB-2B category, job offer from the sponsoring company is required but the company does not need to get an approved labor certification.
To meet the eligibility criteria, you must have been employed outside the US for at least one year in the three years preceding the petition or the most recent lawful nonimmigrant admission if they are already working for the petitioning employer.
The business must have been in operation for at least one year, have a qualifying relationship to the entity you worked for outside the US and intend to employ you in a managerial or executive capacity.

It is important to prove that the applicant will be engaged in day-to-day non-managerial activities. If the applicantβs role seems to be involved in the day-to-day operations of the business such as managing employees, it will be appearing that applicant was not primarily engaged in managerial or executive duties.
You must have received an offer to work as a Manager or Executive and the duties must include:
Personnel Manager
π Manage and control the work of other supervisory, professional or managerial employees
π Supervise and control the work of other supervisory, professional or managerial employees
π Possess the authority to hire and fire or recommend those types of personnel actions for the employees you directly supervise
π Exercise discretion over the day-to-day operations of the activity or function that you have authority over
Function Manager
π Manage the organisation or a department, subdivision, function or component of the organisation
π Manage an essential function with the organisation, department or subdivision of the organisation
π Function at a senior level within the organisational hierarchy or with respect to the function managed
π Exercise discretion over the day-to-day operations of the activity or function that you have authority over
Executive
π Direct the management of the organisation, major component or function of the organisation
π Establish the goals and policies of the organisation, component or function
π Exercise wide latitude in decision-making
π Receive only general supervision or direction from higher level executives, the board of directors or stockholders of the organisation
